Which States is it Legal to Buy CBD Oil?

There is a lot of controversy over whether or not people should be able to buy CBD oil legally. Because it has taken the internet by storm, many think that it is legal to buy CBD oil in all 50 states; however, this is NOT the case, unfortunately.

If you are looking to buy CBD oil, make sure you know which states it is legal in as well as which states it's not legal. Some states have legalized it, but with restrictions.

States Where It is Legal to Buy CBD Oil

Although CBD oil is legal in these states, each state is different and has placed different restrictions on the sale of CBD oil. If you are looking to buy CBD oil, make sure you know the laws regarding it in your state!

The legal States with Exceptions

Unfortunately, there are 16 states where it is legal to buy CBD oil, but there are exceptions to the law. The following states have rules regarding the use and sale of CBD oil:

  1. Alabama: In Alabama, the law states that a prescription for the use of CBD oil can be authorized for debilitating epileptic conditions or any condition that causes seizures. Refer to Leni’s Law for more information in this state.
  2. Georgia: As of 2018, CBD oil is allowed if it contains no more than 5% THC and only for the following conditions: Cancer, PTSD, seizures, Sickle Cell Anemia, Crohn’s Disease, ALS, Multiple sclerosis, Mitochondrial Disease, Parkinson’s Disease, and intractable pain.
  3. Indiana: Although you can find CBD oil on almost any shelf in Indiana, there are some exceptions to it being sold. It must be derived from Cannabis Sativa L. that meets the guidelines of hemp. It cannot contain any more than .3% of THC, and cannot contain any other controlled substances.
  4. Iowa: Iowa is not fully legal yet. However, The Office of Medical Cannabidiol will be issuing registration cards for the use of medical cannabidiol to patients starting December 2018.
  5. Kentucky: In Kentucky, you must have a prescription or a written order of a physician practicing at a hospital or clinic. The physician must also be affiliated with Kentucky Public University.
  6. Mississippi: In Mississippi, CBD oil is considered a controlled medication. So, you are allowed to use CBD oil seizures and other medical conditions as prescribed by your doctor.
  7. Missouri: CBD oil, in Missouri, must be at least 5% CBD and less than .3% THC, and can only be used for epilepsy. The law requires a neurologist to determine that you did not respond to at least 3 treatment options to be eligible for a registration card.
  8. North Carolina: In Carolina, people in possession of CBD must have a registered letter. Patients are allowed to possess CBD, but it is illegal to cultivate or produce it. CBD oil must be composed of less than .9% of THC and be at least 5% CBD.
  9. Oklahoma: The use of CBD oil is permitted under specific ailments. These ailments include epilepsy, multiple sclerosis, intractable nausea, vomiting, and appetite stimulation with chronic wasting diseases. CBD oil may only be .3% THC.
  10. South Carolina: South Carolina is another state that only allows the use of CBD oil for medical purposes. These medical purposes include Lennox-Gastaut Syndrome, Dravet Syndrome, or any other severe forms of epilepsy that can not be treated by traditional medical therapies. Patients may only use CBD oil that is less than .9% THC and 15% CBD.
  11. Tennessee: Tennessee has some of the least restrictive laws when it comes to having restrictions. CBD oil can be used and obtained legally as long as it is less than .9%.
  12. Texas: You will need a prescription in Texas if you want to buy CBD oil. Currently, only those with intractable epilepsy can be prescribed CBD oil that is .5% THC and 10% CBD.
  13. Utah: If you live in Utah, CBD oil use is limited to those with intractable epilepsy who have a signed statement by a neurologist. CBD oil must be less than .3% THC and 15% CBD.
  14. Virginia: Virginia is allowing doctors to prescribe CBD oil that is no more than .5% THC and 15% CBD to patients with any diagnosed condition or disease that the physician sees will benefit from CBD oil.
  15. Wisconsin: Those living in Wisconsin can be prescribed CBD oil with any medical condition.
  16. Wyoming: Wyoming only allows the use of CBD oil for treatment of intractable epilepsy. It must be no more than .3% THC and 15% CBD.

Legal States With NO Exceptions

If your state isn’t on the legal with exceptions or the illegal section, then it is fully legal in your state. You can enjoy the benefits of cannabis and CBD oil without any fear. So, here is your list of awesome states where you can buy CBD oil:

  1. Alaska: In Alaska, CBD is an FDA-approved treatment for many ailments including epilepsy. However, it is completely unregulated.
  2. Arizona: In 2014, Arizona made CBD oil and medical cannabis legal throughout the state. Judge Katherine Cooper made this ruling.
  3. Arkansas: The Arkansas Industrial Hemp Act legalized the use of CBD oil in 2017. However, if it has more than 0.3% THC, it must be prescribed by a doctor.
  4. California: Since California clearly allows marijuana, it is safe to say there are no regulations regarding CBD in California.
  5. Colorado: Again, Colorado is 420 friendly. With the full legalization of marijuana, CBD is just as readily available making it a true legal state with no exceptions.
  6. Connecticut: The house bill 5780 signed by governor Dannel Mallory excluded Hemp products from the list of controlled substances and made it industrial Hemp legal throughout the state.  
  7. Delaware: Thanks to the house bill 385 being passed in 2014, has made it legal to buy and sell Hemp. Along with this, Delaware opened the use of medical marijuana in 2015 which allows residents to possess 6 ounces of medical cannabis at any given time.
  8. District of Columbia: District of Columbia is a little up and down with the laws because it is in a state that doesn’t have the same laws. If you are in the District of Columbia, there is no restriction of CBD and the use of marijuana is legal for recreational use, but the sale of it is not. Just be careful you know where the lines are if you choose to use cannabis in the District of Columbia.
  9. Florida: Governor Rick Scott signed the Senate bill 1030 into effect which legalized the use of CBD oil with up to 8% THC (this is higher than most states which only allow 0.3% THC).
  10. Hawaii: CBD oil is completely legal to purchase with no restrictions. However, CBD over the counter must meet all national standards for industrial hemp.
  11. Illinois: CBD is approved as of this year to legalize the sale of industrial Hemp. CBD is must also meet the guidelines of less than 0.3% THC.
  12. Louisiana: Amazingly, cannabis has been used medicinally in Louisiana since 1978. Although recreational use of marijuana is still illegal, the use of CBD with less than 0.3% THC is widely acceptable.
  13. Maine: CBD is legal to purchase in Maine. However, the crops that grow Hemp must be industrial crops and not commercial. You can freely use CBD in any form in Maine.
  14. Maryland: Maryland has a few different rules than DC. In fact, the legalization of medical marijuana has only recently happened. In Maryland, CBD is perfectly legal. It is also legal to possess 1 ounce of marijuana at a time without getting into trouble.
  15. Massachusetts: Recently, Massachusetts signed into the law the legal use and sale of recreational cannabis. This means that you can enjoy both CBD or marijuana without fear.
  16. Minnesota: In 2014, the Farm Bill was signed which made CBD oil accessible to citizens throughout the state. However, it is not available in the form of smoking.
  17. Montana: In 2018, a new farm bill for Montana was signed by President Trump. This bill made Hemp products like CBD legal and exempt from controlled substance acts. Marijuana is also legal for medical reasons.
  18. Nevada: Nevada has fully legalized the use and sale of CBD throughout the state. This includes both Hemp based CBD oils and Marijuana based CBD oils. Residents can, also, legally carry up to 1 ounce of marijuana.
  19. New Hampshire: Industrial Hemp is fully legal to buy and use in the state of New Hampshire. The Farm Bill to allow this was passed in 2014.
  20. New Jersey: In New Jersey, over-the-counter CBD derived from industrial Hemp can be bought in stores and online without any restrictions. This was passed in 2014 with the Farm Bill.
  21. New Mexico: CBD is available across the state of New Mexico as long as it is produced by industrial Hemp. New Mexico has also enacted several medical marijuana programs to study the effectiveness of marijuana for specific ailments.
  22. New York: New York legalized medical marijuana in 2014. In fact, possession of up to 25 grams or less has been decriminalized. This means those wanting to use CBD, are in the free and clear.
  23. North Dakota: Pro industrial Hemp legislation was passed in North Dakota in 1999. Therefore, those in the “peace garden state” can buy CBD oil without fear.
  24. Ohio: Ohio was the 25th state to legalize the medical use of marijuana. This means CBD is perfectly legal as long as it contains low amounts of THC (less than 0.3%).
  25. Oregon: The state database of Oregon shows 53 industrial Hemp growers. Oregon also allows marijuana use of recreational marijuana. This means, if you live in Oregon, you can freely buy and use CBD oil as well as marijuana.
  26. Pennsylvania: Because Pennsylvania has approved medical marijuana, CBD can be derived and used from both marijuana and industrial Hemp plants. Citizens have no reason to fear using CBD in Pennsylvania.
  27. Rhode Island: The legalization of Hemp products in Rhode Island happened in 2015. Although CBD is completely legal to buy and use, recreational marijuana is still illegal. So, be sure your CBD contains 0.3% or less THC.
  28. Vermont: Marijuana for recreational use is legal in marijuana, and an adult 21 and older can have up to 1 ounce in their possession. In fact, legal aged adults may grow up to 2 plants in their home. With lax laws around cannabis, there is no reason to fear using CBD in Vermont.
  29. Washington: Recreational use of cannabis is fully legal in Washington. There are no restrictions on CBD.
  30. West Virginia: Farmers in West Virginia are not allowed to sell commercial Hemp. However, the sale and use of industrial Hemp is statewide. Therefore, there is no fear of using CBD oil in West Virginia.

States Where it is Illegal to Buy CBD Oil

Unfortunately, there are still states that haven’t changed with the times and do not know what CBD oil is or it benefits.  Luckily, though, there are only 4 states where it is illegal, and some will have a decision on this year’s ballot:

  1. Nebraska: Nebraska has two measures to get CBD oil legal. With 7% of voter signatures, The Nebraska Marijuana Decriminalization Initiative and the Nebraska Right to Cannabis Initiative may get the use of cannabis on the ballot.
  2. Kansas: Unlike other states, residents cannot introduce or pass legislation. Therefore, it is totally illegal to use, sell, or buy CBD oil in Kansas.
  3. South Dakota: CBD oil was added to the list of controlled substances. In South Dakota, it is completely illegal to buy, use, or sell CBD oil in this state.
  4. Idaho: Supporters of CBD are in the process of collecting 48,793 valid signatures to approve the sale and use of CBD oil.

If CBD oil is not legal in your state, make sure you get out there and vote! CBD oil is not marijuana.

    When you talk about percentages of thc, are you talking 3%, 7% , or .3% or .7 % and such?
